This User Agreement is effective upon acceptance for those users who accept it either by using Bazaraki or through registration of a Bazaraki account.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE AS THEY ARE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND US.

Introduction

This User Agreement, Mobile Device Terms, Data and Privacy Policy and Cookies Policy (collectively referred hereto as “Terms”) set out the rules for using our domain (Bazaraki.com) including our website: www.bazaraki.com (hereinafter the “Website”), as well as any sub-domain or sibling-domain registered to BZRK Limited or any affiliate company and any Uniform Resource Locator (URL) or Application Programming Interface (API) or Bazaraki Mobile Application by which Bazaraki’s data may be accessed (collectively Bazaraki.com, Website, as well as any sub-domain or sibling-domain registered to BZRK Limited or any affiliate company and any Uniform Resource Locator (URL) or Application Programming Interface (API) or Bazaraki Mobile Application by which Bazaraki’s data may be accessed shall hereinafter referred to as “Bazaraki”),

Bazaraki is a marketplace that allows users to advertise and offer, sell and buy just about any goods or services in a variety of pricing format and locations within the Republic of Cyprus, where users can advertise whatever, they wish to sell or promote or advertise, based on these Terms, and according to the laws and regulations of the Republic of Cyprus and, they can search for a product or service that they wish to buy (hereinafter “our Services”).

Bazaraki and the Company are not involved in the transaction between the Users. The contract for the sale or rent or purchase a service or establish a business relationship is directly between the Users.

Bazaraki and the Company do not provide any legal advice or help by any means.

While we may provide pricing, postage, listing and other guidance in our Services, such guidance is solely informational, and you may decide to follow it or not. Except for certain checks, including those designed to verify that listings do not include illegal content, as indicated in these Terms, we do not review users’ listings or content. While we may help facilitate the resolution of disputes, Bazaraki and the Company have no control over, and, unless expressly provided, do not guarantee the existence, quality, safety or legality of, Items advertised; the truth or accuracy of Users’ content or listings; the ability of sellers to sell Items; the ability of buyers to pay for Items; or that a buyer or seller will actually complete a transaction or return an Item.

A reference to “you” or “your” is a reference to the User of Bazaraki as determined below, and shall be read and interpreted according to the content.

Definitions

  • Active Simple Ad: means the Regular ad that a User can post in Bazaraki and appear after VIP and Top Ads
  • Ad or Ads: means simple ads, Top Ads and VIP Ads. These are determined in the section “Help” on the Website.
  • Advertised User: means the person (either physical or legal) who is listing Ad or Ads (either to sell or rent or conclude an agreement with the Interested User, including but not limited to estate agents, commercial agents, lettings agents, landlords, new home developers, homeowners, owners of the products, providers, employers)
  • Bazaraki Account: means the account created within Bazaraki as per paragraph 5.1. of these Terms.
  • Cyprus: means the Republic of Cyprus.
  • Data Scraping: Similar to web scraping, it involves the automated collection of data from any source, including databases and APIs.
  • Interested User: means the person (either physical or legal) who wishes or is interested to an Ad with intention to buy Item, product or service or to conclude an agreement with the Advertised User.
  • Listing Policies: means the listing conditions in paragraphs 6.1 and 6.2. herein.
  • Object/Item: means any tangible material (including but not limited to goods, cars, real estate etc.) or intangible material (such as services) that constitutes the object of an Ad.
  • Real Estate: means and includes but not limited to any land, apartment, house, building, residential or commercial.
  • Top Ads: means the Ads that are displayed after VIP Ads
  • User/s: means the Advertised User, the Interested User or visitors of Bazaraki.
  • VIP Ads: means the premium Ads on Bazaraki
  • Web Scraping: The automated extraction of data from a website, typically using a bot or software tool.

1. Who we are and how to contact us

1.1. We are BZRK LTD, company incorporated under the laws of the Republic of Cyprus, with registration number HE 185425 and registered address Prodromou 121, 2064, Nicosia, Cyprus (referred to as the “Company” “we” or “us” or “our”, including but not limited to employees, directors, associates, officers and any other related party).

We are not a property sales or lettings agency or Human resources agency or the sellers, or advertisers of any product or service. We are the providers of Bazaraki as described above. It is the Advertised Users that display content for you to view.

2. By using Bazaraki, you accept these terms

2.1. These Terms set out all the rules and obligations that apply to your use of Bazaraki.

2.2. By using Bazaraki, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use Bazaraki.

2.3. By continuing to use Bazaraki, Users agree to comply with these Terms and acknowledge that any breach of the same may result in severe consequences, including legal action.

2.4. You must be at least 18 years of age to use Bazaraki. By using Bazaraki and accepting these Terms, you confirm that you are at least 18 years of age. If you are under 18 you can use Bazaraki only with the consent of a parent or guardian.

2.5. We recommend that you download and store a copy of these Terms for future reference. They are a legally binding agreement between you and us.

2.6. These Terms may also make reference to other terms that apply when using Bazaraki, such as our Data and Privacy Policy and Cookies Policy.

2.7.  When you access Bazaraki Services by using Bazaraki mobile application, Mobile Devices Terms are additionally applicable. Your use of Bazaraki mobile device application confirms your agreement to the Terms.

3. We may make changes to our Terms and Bazaraki.

3.1. We amend these Terms from time to time by updating them on Bazaraki. Every time you wish to use Bazaraki, please check these Terms to ensure you understand the terms that apply at that time.

3.2 We may from time to time change the content of Bazaraki or suspend or  discontinue any aspect of Bazaraki, which may include your access to it.

4.  Prohibition of Web Scraping and Data Scraping Software or Systems

The following section outlines the rules and restrictions regarding the use, distribution, and promotion of web scraping and data scraping software or systems on Bazaraki.

4.1. Prohibited Activities

Users are strictly prohibited from posting, distributing, or promoting on Bazaraki any software, tools, scripts, or systems designed for web scraping or data scraping.

Users are further prohibited from using on Bazaraki any automated systems or other software, including bots or spiders, or access to Bazaraki for the purpose of scraping data, harvesting data, by means of any data extraction method.

4.2.  User Responsibility

Users must ensure that all software, tools, or systems they use which may affect Bazaraki, or post, distribute, or promote on Bazaraki, comply with the present Terms and Conditions.

Users are prohibited from using Bazaraki in a way that may harm the Company, its employees, other users, or the community by extracting data without prior written permission from Bazaraki.

4.3. Reporting Violations

Users are encouraged to report any suspected violations of this section to our support team immediately.

Reports can be made via the Bazaraki support portal or by emailing info@bazaraki.com.

We shall investigate any reports submitted in relation to the suspected web or data scraping.

4.4. Enforcement and Penalties

Any User found in violation of this section will be subject to immediate suspension or termination of their account. We reserve the right to suspend the activity of any Bazaraki account for which an investigation is being carried out in relation to the suspected web or data scraping.

The Company reserves the right to pursue legal action against Users who violate this section, including seeking damages and injunctive relief.

Users found in breach of the terms included in paragraphs 4.1. & 4.2. of these Terms, may be liable for any damage caused to the Company or other Users, including legal costs and expenses incurred.

5. General Terms

The rules including in this paragraph are applicable to all categories, as well as to all Users of Bazaraki.

5.1 Creation of Bazaraki Account

5.1.1. To gain full access and use all features and information on Bazaraki, and to post an Ad and/or access the contact information of the Sellers in most categories of Ads, it is necessary to create and log in with a personal Bazaraki Account.

5.1.2. We may, at our sole discretion and at any time, modify the categories of Ads for which it is necessary to log in with a Bazaraki Account to access the Advertised Users contact information, without prior notification and/or warning to the Users. These measures are required to protect the Users.

5.1.3. You can create a Bazaraki Account through the Website by selecting “Sign in and register” by using a Cypriot (+357) phone number or a number of any country as it is displayed from time to time on the Website. A verification code will be sent to you via SMS, WhatsApp, Telegram or any other messaging platform to ensure the correctness of the phone number you have used to sign in. Bazaraki may, at its absolute discretion and at any time, allow the creation of a Bazaraki Account using a phone number from any country, without prior notification and/or warning to the Users.

5.2.  Verification of Bazaraki Account

5.2.1. If you create a Bazaraki Account using a phone number of any other country (than Cyprus), the verification of your personal information through the Yoti platform is required (the “Verification Process” and “Age Verification Process”) in order to be able to post an Ad in most categories available on Bazaraki. We may, at our absolute discretion and at any time, amend the categories for which completion of the Verification Process is not required for the posting of Ads, without prior notification and/or warning to Users.

5.2.2. The Verification Process and the Age Verification Process require some information and documents (such as a copy of an Identity Card or Passport) to be submitted to the Yoti platform. The verification through the Yoti platform is a process independent from Bazaraki, its processes and systems.

5.2.3. The Verification Process and the Age Verification Process, including the processing of personal data by Yoti, are governed by the Yoti Platform Terms and Conditions. Bazaraki may process personal data to be submitted to the Yoti Platform for the purposes of verifying a Bazaraki Account, in accordance with the Data and Privacy Policy.

5.2.4. If the Verification Process is unsuccessful, please try to complete this process again. Once the Verification Process is complete, you may proceed to post Ads in accordance with these Terms, for Objects available in Cyprus and/or Greece. The posting of Ads in the categories “Real Estate for Sale” and “Real Estate for Rent” is permitted only for Real Estate in Cyprus.

5.3.  Use of Bazaraki

5.3.1. By using Bazaraki (either you have an account with us or not) you agree that you will not:

  1. violate any EU and/or Cyprus laws and/or our terms and policies;
  2. infringe any third-party right including but not limited to any copyright, trademark or other intellectual property rights or rights of any third party whatsoever;
  3. impose or contribute to imposing an unreasonable or disproportionately large load on our infrastructure or interfere with the proper working of Bazaraki;
  4. copy, modify, or distribute any other person’s content without their consent;
  5. publish, disclose, reproduce, or create any derivative works from any information contained in Bazaraki;
  6. use any robot spider, scraper or other automated means to access Bazaraki and collect content for any purpose;
  7. copy, modify or distribute rights or content from Bazaraki or Bazaraki’s copyrights and trademarks;
  8. use Bazaraki’s name or any logos or trademarks of Bazaraki for any purposes and in any way, including but not limited in a defamatory or derogatory manner or in any way that might bring Bazaraki, or its directors or employees into disrepute;
  9. include in your listing/s or in your communication/s with any User or any Company’s employee or associate or officer, any threat and/or threatening, obscene, offensive, hateful, discriminatory, unethical, immoral, inflammatory, defamatory, misleading, discriminatory, or indecent content/messages/text/material;
  10. upload illegal content or use Bazaraki in the facilitation or commission of a criminal offence;
  11. harvest or otherwise collect information about Users, including email addresses, without their consent;
  12. bypass measures used to prevent or restrict access to Bazaraki;
  13. violate the rules for posting Ads, as determined in paragraphs 6.1. and 6.2. hereinbelow;
  14. post or otherwise communicate either internally through Bazaraki chat or privately any abusive, threatening, discriminatory, false, inaccurate or misleading material or message of any kind, in any way;
  15. distribute spam, chain letters, or promote pyramid schemes;
  16. distribute viruses or any other technologies that may harm Bazaraki or the interests or property of Users or Company;
  17. sell any counterfeit Items; and
  18. rely on the information displayed in any Ad and you should not enter into any contract or commitment whatsoever, without taking all necessary steps and measures to check, examine and confirm the accuracy of that information, by your own or through your authorised representative and directly with the person (either individual or legal entity) who posted the Ad.

5.3.2.   Additional Terms

Additional to the above paragraph 5.3.1., you acknowledge and agree that:

  1. We are not obliged to and do not review, check or control any person or organisation or any legal entity that upload Ad/s on Bazaraki.
  2. The information on Bazaraki is provided purely for informative purposes and does not constitute or form part of any offer or invitation by Bazaraki.
  3. We shall not be under any obligation to monitor or censor the information and/or Ad that appears on Bazaraki.
  4. Neither Bazaraki nor the Company shall be liable for any errors or omissions in information or Ads.
  5. Technological failure may impede the provision of the listing services or prevent access to all, or any part of the Ad or information displayed on Bazaraki. We make no representation or warranty that Bazaraki, the listing services, or the information displayed or Ad will be always accessible or available, or that the whole or any part of Bazaraki, listing services or the information will be free from error and while we will make reasonable endeavours to notify you in advance, we may suspend temporarily or alter the operation of Bazaraki, or listing services without notice to you.
  6. All intellectual property rights in Bazaraki, technology supporting our Services and Bazaraki are vested in Company and/or its licensors/sub-contractors and that you have no rights in, or to, such intellectual property. For the avoidance of doubt, save to the extent otherwise specified in these Terms, all intellectual property rights in the information published by you and Ad shall remain vested in you (or your licensors, as applicable).
  7. No licence or right is granted to you in these Terms to use any of our intellectual property, specifically any trade mark, name or logo of Bazaraki or its affiliated companies including, without limitation, the Trademarks.
  8. If at any time you may think that any listing is misrepresenting true facts or is misleading, then you will report the listing through the Bazaraki Help page. The listing and the persons that posted it, will be investigated, and if your claim is justified the listing will be removed from Bazaraki.
  9. The communication is and shall be conducted between the Users. Bazaraki and the Company are not and shall not get involved in such communication.
  10. If the communication is conducted through Bazaraki chat then, we only notify you about the messages that you have received.
  11. We do not participate nor getting involved in any deal or agreement that is conducted between the Users.
  12. We are not responsible for any loss or damage of any sort incurred as a result of any dealings or deals or agreements that have been entered into between the Users.

6. Listing Conditions for Advertised Users

6.1.  When listing an Ad in Bazaraki, you agree and comply with the following conditions:

6.1.1. Contact details should be added to the corresponding fields and descriptions may not be displayed in titles. In the description field, you will have more space to describe what you are advertising.

6.1.2. Please use clean, clear, and accurate photos. You cannot place your contact information (phone number, address, email, link on Facebook) on product images. Images with words like “urgent”, “clearance”, “for sale” “good price” and so on are also prohibited. Misleading, fraudulent images are not allowed.

6.1.3. You must always ensure that listing details included in the Ads are legitimate and correct, in compliance with all applicable laws, regulations and codes of practice in the Republic of Cyprus and any compliance guidelines published or made available by Bazaraki from time to time.

6.1.4. We may without prejudice to our rights as set out in these Terms, require the information to be amended at any time if we consider or have reason to believe that you are in breach of the Terms or any applicable law or regulation or where it deems at our absolute discretion that the information included in an Ad is of poor quality in terms of presentation, information provided or otherwise.

6.1.5. It is only acceptable by legal entities when a photo contains a logo written only at the bottom or in the middle of the photo using small and transparent letters.

6.1.6. No links to other websites in your ad are permitted, except in certain cases such as in job Ads.

6.1.7. You are not allowed to post pictures of products in Bazaraki that you do not own.

6.1.8. You are advised to post your Ad under the most suitable category to get more exposure and users who search for it to find it more easily.

6.1.9. You can post one Ad per Item, and one Item per Ad. Just so nobody gets confused, do not post duplicate ads.

6.1.10.     You are not allowed to use the name of “Bazaraki” in the description of your post.

6.1.11. You can sell an Item, on the express condition that it is in your possession or have obtained the consent of the owner.

6.1.12.     You have the authority to market the listing/s, and have all necessary authorities, consents and licences necessary to use, display, reproduce a listing.

6.1.13.     No spam allowed. This includes ad spam and keyword spamming in ads.

6.1.14.     If you have sold the Item, deactivate the Ad.

6.1.15.     You assume full responsibility for the Item offered and the accuracy and content of the listing, including listing content created using tools offered by Bazaraki or third parties such as translation, image editing, and generative artificial intelligence tools.

6.1.16.     The content you provide complies with all our Listing Policies, including the images, videos and text policy.

6.1.17.     Content that violates any of our policies may be modified or deleted at our sole discretion.

6.1.18.     We may revise listings to supplement, remove, or correct information.

6.1.19.     You will not sell and will promptly remove all listings for any product recalled by a manufacturer or governmental authority if the sale of the product is prohibited by law or regulation or if the product poses a health or safety hazard as specified by any governmental authority. We do not undertake any responsibility or liability for the safety or performance of any product that you list or sell, including any product that is subject to a recall. You are solely responsible for any non-conformity or defect in, or compliance with any public or private recall of, any product you list or sell by using Bazaraki.

6.1.20.     We may at our absolute discretion, at any time, remove, cause to be removed or decline to display any information or Ad on Bazaraki which fails to comply with these Terms, and shall notify you of such decision and the reason of rejection or removal at the time of, the relevant Information and/or Ad being removed or rejected.

6.1.21.     You shall not list Ad/s which contains any of the following:

  1. Enhancing drugs;
  2. Alcohol;
  3. Animal parts;
  4. Cigarettes, electronic cigarettes, liquid for smoking and related products;
  5. Competing websites;
  6. Dangerous and/or illegal gases and substances;
  7. Drugs and drug paraphernalia;
  8. Any medicinal products whether requiring a prescription or not;
  9. Food, drink and supplements;
  10. Firearms and ammunition (even if it is legal to buy them);
  11. Steel arms (knife etc);
  12. Fireworks of any kind;
  13. Gambling;
  14. Historical artifacts / protected heritage goods;
  15. Personal information or mailing lists;
  16. Propaganda;
  17. Stolen Objects;
  18. Terroristic propaganda / accessories;
  19. Threatened / protected wild life, plants and insects;
  20. Threatening, discriminating, violent or offensive behavior;
  21. Trade in human beings;
  22. Any kind of currency (except for numismatic purposes);
  23. Gift cards, vouchers, coupons, tickets, gift certificates;
  24. Fortune-telling, magical services, supplies and goods;
  25. Personal hygiene devices;
  26. Online and offline money loans, company liquidation and credit services;
  27. MLM, Pyramid and referral schemes;
  28. Ivory and all products derived from ivory or protected wildlife species including taxidermy items, shells, corals, teeth, bones, skins and any items made from endangered or CITES-listed species;
  29. Accounts or digital items from online games or distribution platforms (including Steam, Origin, EA, Battle.net, Epic, etc.)
  30. Copied, pirated or duplicated games, DVDs, films, music or software.
  31. Items promoting hate, discrimination, stereotypes or extremist ideology.

 

6.2.  Additional Listing Conditions for Advertised Users

In addition to the conditions listed in paragraph 6.1 hereinabove, when you list an Ad in Bazaraki, in relation to the categories and sub-categories included in this paragraph, you acknowledge and agree that:

 

6.2.1. Real estate

  1. You may list Ad/s regarding property/ies that are located exclusively within the Republic of Cyprus.
  2. You can list an Ad in relation to real estate in Bazaraki, only if you are:
    1. (i)  the owner of real estate,
    2. (ii)  developer,
    3. (iii) licensed real estate agent,
    4. (iv) legal representative of owner/s of real estate pursuant to a relevant Power of Attorney and
    5. (v)  first-degree relatives of the owner/s of real estate.
  3. Bazaraki operates as an advertising platform and not as a licensed real estate agent. As such Bazaraki is not involved and cannot help with any transaction related to real estate.
  4. If you choose to create a private account in the Real Estate category and you are a real estate agent or assistant real estate agent, you will be able, at your discretion, to include your license number in the description of each Ad and you are required to be aware of and comply with the relevant legislation of the Republic of Cyprus, including the Real Estate Agents Law N.71(I)/2010 as amended and/or as may be amended from time to time. The responsibility for the validity of the details you provide rests solely with yourself.
  5. If you are a licenced real estate agent you should be aware and abide by any applicable industry code of conduct, recommendations or guidelines issued by the Real Estate Registration Council or any other competent authority and will provide a contactable telephone number and shall ensure that the majority of calls made to that telephone number are answered in person.
  6. If you are neither a real estate agent nor the owner of the property, it is your responsibility to read and be aware of the relevant laws and regulations of the Republic of Cyprus, as well as the provisions and requirements of the laws and regulations related to the real estate (including but not limited to the Law on Real Estate Agents No. 71 (I) 2010 as amended or as may be amended from time to time.
  7. If you are a representative of a legal entity and you are acting for and on its behalf please refer to the Account Verification for Business Account for Real Estate Category.
  8. We cannot arrange viewings of the listed Real Estate.
  9. Person/s or companies listing Real Estate on Bazaraki is/are responsible for the integrity of the information provided, which is in all respects true, complete and accurate to the best of its/their knowledge and belief and he/she/they shall promptly update or correct Information by himself/herself/themselves or with necessary changes to xml.
  10. We reserve the right to charge you for additional fees or in a manner it deems appropriate or on a per property basis if we have reason to believe that Ad and/or information uploaded by any of your branch offices is in breach of these Terms.
  11. Any form of fiduciary or estate agency relationship between us and the Users, owners or real estate developers and agents does not exist.

 

6.2.1.1.  Sale of property

  1. We are not in contact with the interested sellers or buyers.
  2. We elevate our Services with a new project within Bazaraki (hereinafter the “Project”) concerning the residential and commercial properties which are under construction or are newly constructed, either by developers or real estate agents (if those are listed with real estate agents). As the Project is conducted on a trial basis, eligible advertisers during the trial period are limited to selected existing Bazaraki Business clients.  We shall obtain the information related to the residential and commercial properties which are under construction or are newly constructed, either by the respective developer or real estate agent, as well as the information related to the relevant developer or real estate agent including but not limited to the logos of the developer/real estate agent, telephone number/s, contact person/s, specifications of the property, photos and any other information related to the specific property. The only and exclusive purpose is to facilitate the process of the Ads for and on behalf of the respective developers/real estate agents however, do not undertake any responsibility for the truthfulness and accuracy of the information provided and shall not be involved in any sale/purchase transaction of any property, either by the developers/real estate agents side or the buyer/s side. The Terms displayed are also applicable for the Project.

 

6.2.1.2.  Rent of property

  1. Bazaraki is not in contact with the interested landlords or tenants.
  2. If you list your property for rent, be sure that you are familiar with the relevant law. Specifically, with regards to the listings for self-catering accommodations (as determined in the Fifth Appendix of the relevant law - Ο περί της Ρύθμισης της Ίδρυσης και Λειτουργίας Ξενοδοχείων και Τουριστικών Καταλυμάτων Νόμος του 2019 - 34(I)/2019 - ΠΕΜΠΤΟ ΠΑΡΑΡΤΗΜΑ), you may post a listing to rent out your property, provided that it is registered in the Register of Self-Catering Accommodations, which is maintained by the Deputy Ministry of Tourism, and you have obtained the relevant registration number. This number must be included in the relevant listing in the description section at the beginning of the description. Therefore, if a listing concerning a self-catering accommodation does not include the correct registration number, will be rejected.
  3. You either as owner/s and/or manager/s of such accommodations should comply with the laws of the Republic of Cyprus and adhere to the circulars and relevant regulations issued by the Deputy Ministry of Tourism from time to time.
  4. It is your responsibility to assess whether the property you intend to advertise falls within the scope of the relevant law. Bazaraki does not provide legal advice and accepts no responsibility for any issues that might arise or any fines that may be imposed due to non-compliance with the provisions of the laws. If you have any doubt regarding the rental of your property, and whether it falls within the provisions of the said Law, we encourage you to seek legal advice or contact the Deputy Ministry of Tourism.
  5. In case the competent authorities contact us regarding listings of self-catering accommodations that do not comply with the laws of the Republic of Cyprus, they will be removed, informing the Advertised User.

 

6.2.2. Animals/Plants

  1. In the “Animals-pets” category, any listing that mentions a purebred animal must have the relevant certification document available upon request for further verification. In case where the User fails to provide us with the relevant certificate (if requested), we reserve the right to remove the listing without notice.
  2. According to the provisions of Dogs’ Laws of 2002 until 2019, as well as the Protection and Welfare of Animals (Acquisition and Sale of Animals) Regulations of 2021, as these are amended from time to time, the sale of animals is prohibited to be conducted by non-licensed persons. The sale of animals is conducted by persons who operate properties taking care of animals with intention to sell them and they are obliged to acquire the relevant certificate for that purpose, issued by the competent authority.
  3. A person who proceeds with the publication of advertisement for sale of animals, acquires the relevant certificate. The Advertised User undertakes the full responsibility towards the Law, in case of posting an Ad without the relevant certificate. We do not accept and/or undertake any responsibility (direct, indirect, consequential or in any other way), in relation to the sale of animal/s.

 

6.2.2.1.  Prohibited animal species

You confirm that you are aware of the prohibited animal species and that the import, sale, advertise for sale, offer or animal exposure of any of them is prohibited by the law. You are not allowed to advertise any of the below listed animal species:

  1. Any animals that belong in the family of:
    1. (i)     Antilocapridae, Suidae, Tayassuidae
    2. (ii)     Bovidae (Antelope, Bison, Buffalo, Wildbeest, Impala, Gazelle).
    3. (iii)     Camelidae (Llama, Dromedary, Camel, Alpaca, Vicuna, Guanaco).
    4. (iv)     Carnivora (Candilae, Felidae, Mustelids, badger, Raccoon, Skunks and any other similar that belong in this families) - (Exception in Dogs Canis lupus familiaris).
    5. (v)     Crocodylia (Crocodile, Alligators, Gharial and any other similar that belong in this families).
    6. (vi)     Cervidae (Deers, Moose, Muntjac. Elk, Chital, Reindeer, Roe deer and any other similar that belong in this families).
    7. (vii)     Diprotodontia (for example: Kangaroo, Wallaby, Koala, Wombat.
    8. (viii)     Equidae (Exception in: horses, donkeys).
  2. Cyprus warbler (Sylvia melanothorax).
  3. Cyprus wheatear (Oenanthe cypriaca).
  4. Short - toed treecreeper (certhia brachydactyla dorotheae).

    3. (iii)     puppies, kittens and other mammals may not be sold before 8 weeks of age.

6.2.3.  Timber

  1. You comply with the legal requirements, and you have all the legal permits for the cutting and sale of the timber that you advertise.
  2. You are well-informed and aware of the relevant legal consequences in case of non-compliance with the laws in respect of the sale and cutting of the timber.

 

6.2.4.  Adult Services

  1. This paragraph covers the categories of “Erotic massage, adult services (18+)” and “Adult products (18+)”.
  2. You are over the age of 18.
  3. You shall provide all necessary information such as your Identity card, date of birth, full name and contact details.
  4. We have no responsibility for the content of the Ads. Exclusive responsibility, whether criminal or of any other nature, is solely on the person who makes the Ad.
  5. The photos posted and the services advertised concern the person who posts the ad.
  6. The Ads in this section are made with your own free will and are not the product of pressure or otherwise by third parties.
  7. You will not upload photos of people under the age of 18 or photos of children.
  8. We do not review the Ads of the Advertised Users and do not participate in the actual transactions between Users.
  9. This section may include sexual content for which we have no responsibility.
  10. You do not promote or participate in any illegal act that constitutes a criminal or other offence under the laws of the Republic of Cyprus.
  11. For the purposes of preventing offenses under the Prevention and Combating of Trafficking and Exploitation of Persons and the Protection of Victims Law 60(I) of 2014 (Law 60(I)/2014), you will need to undergo a personal data identification process, and the verification of the age process as per paragraph 5.2. of these Terms.
  12. You are solely responsible for all information that you submit to Bazaraki and any consequences that may result from your Ad, including possible prosecution by the competent authorities.
  13. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breaching the Terms. We also reserve the right at our discretion to restrict a User’s usage of Bazaraki either temporarily or permanently or refuse User’s registration. In case that there are indications that you are violating these Terms, in any way and/or behaving suspiciously on Bazaraki, we have the ability, at our sole discretion, to take the measures that we deem necessary and appropriate and to inform others Bazaraki’s Users who have contacted you and recommend them to be wary.
  14. In case that accounts are unverified or inactive for a long period of time, we reserve the right, at our sole discretion, to deactivate them. In addition, we reserve the right to refuse, modify or terminate all or part of our Services to anyone for any reason at our sole discretion, in order to ensure the best possible operation of Bazaraki.
  15. The use of Bazaraki for human trafficking, slavery, sexual harassment, sexual abuse, sexual exploitation of children and/or adults or child and/or adult’s pornography is strictly prohibited. Any attempt to use Bazaraki or its Services for trafficking of any kind will result in account closure, exclusion from using Bazaraki, and potential legal repercussions.
  16. You warrant, represent and undertake to the Company that:
    1. (ix)     neither yourself nor through any other person commit or shall commit any offence by using Bazaraki, indicated and/or included directly or indirectly, to any applicable laws, regulations, rules and codes that provide slavery, servitude and forced or compulsory labour and human trafficking, sexual harassment, sexual abuse, sexual exploitation of children and child pornography and/or adults including but not limited to the Prevention and Combating of Trafficking and Exploitation of Persons and the Protection of Victims Law 60(I) of 2014 (the “Anti-Trafficking Law”) and the Prevention and Combating of Sexual Abuse, Sexual Exploitation of Children and Child Pornography Law of 2014 (91(I)/2014) (the “Child Anti-Exploitation Law”);
    2. (x)     you are aware of the provisions of Anti-Trafficking Law and Child Anti-Exploitation Law and neither yourself nor through any other person shall use Bazaraki by any way that contradicts to and/or infringe the provisions of the Anti-Trafficking Law and the Child Anti-Exploitation Law; and
    3. (xi)     you are aware that it is prohibited to use Bazaraki on the contrary to the Anti-Trafficking Law and the Child Anti-Exploitation Law.
  17. We urge all Users to comply with all applicable laws and regulations of the Republic of Cyprus, especially in relation to the Anti-Trafficking Law and Child Anti-Exploitation Law. Bazaraki and its content is not intended to create any relationship between the User and the Company or any other third party.
  18. The publications, the advertisements, the posts and their content are published/uploaded directly by the Users of Bazaraki and thus the Company does not assume any responsibility or liability for any content.
  19. We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of the adult services or the content or the information of the advertisements or posts uploaded on Bazaraki.

7. Conditions of Interested Users

7.1.  If you are Interested User in purchase or rent a Real Estate, you agree and acknowledge that:

  1. It is good practice to make reasonable enquiries before you proceed to buy any Real Estate. Therefore, you should independently ensure that the information in relation to the Real Estate you are interested in is authentic, correct and accurate.
  2. The information supplied by the Advertised Users in relation to advertising properties are not guaranteed by Bazaraki and its validity needs to be confirmed by the respective Advertised User.
  3. All enquiries in relation to real estate, must go to the Advertised Users.
  4. We strongly recommend that you get a legal advice prior to proceeding with any form of real estate transaction.

7.2.  If you are Interested User in purchase of any adult service, you agree and acknowledge that:

  1. The purchase of any adult service through Bazaraki is conducted with your own sole responsibility and at your own risk.
  2. Bazaraki and the Company do not approve or consent to any form of human trafficking and/or exploitation and takes no responsibility for any activities related to them. The human trafficking and/or exploitation and/or the participation in human trafficking and/or exploitation are illegal and lead to proceedings before the competent authorities.

8. Fees

8.1.  The use of Bazaraki is initially offered free of charge, with the exception of the provision of certain services that require the payment of a specific fee, which varies according to the category of the Ad and the demand prevailing in the specific sector.

8.2.  If the service you are using is subject to a fee or the payment of a specific fee for its posting, you’ll be able to review and accept the terms that will be clearly disclosed at the time you post an Ad. Our fees are quoted in euros, and we reserve the right to modify at any time without notice but always providing Advertised User with the respective information. We may choose to temporarily change our fees for promotional events or new services.

8.3.  Please note that the charges of premium ads (VIP/TOP) might be varied from time to time and from User to User, based on multiple criteria including not only the nature, the geographical position of the Ad that is displayed, the offer and demand but also several other factors based on which certain tests are conducted by implementation of fully automatic system (algorithm) which is in place for the provision of our best Services.

8.4.  Bazaraki accepts payments by methods indicated in the Payment Methods.

9. Refund and Cancellation Policy

9.1.  You are responsible for paying Bazaraki fees when they are due. If you do not, without prejudice to any other right or remedy we may be entitled to under these Terms or by law, to limit your ability to use Bazaraki.

9.2.  You agree that your Ads may be deleted from Bazaraki in case we reasonably believe that the Terms, are breached, either directly or indirectly and we reserve the right not to refund the User for any fees paid.

9.3.  Moreover, Bazaraki users cannot cancel the services already paid to Bazaraki.

9.4.  As mentioned in paragraph 8 above, if the Service you are using is subject to a fee or the payment of a specific fee for its posting, you’ll be able to review and accept the terms that will be clearly disclosed at the time you post your ad. To be able to continue you should pay the relevant fee for the payment of the service. Thus, provided that the service is pre-paid, you are not eligible for a refund.

9.5.  Please check the amount you have selected prior proceeding with the payment of any Service.

9.6.  Provided that certain specific cases to which the User has not used the service/s, are exempted, and the User:

  1. may ask for a refund through the payment gateway used for the payment (Google Play, Apple Pay, Paypal, etc.) and
  2. should inform the Company by sending email at the following email address: info@bazaraki.com about his refund request by providing also the necessary documents. In this email the User should also include the date on which the relevant refund request has been submitted to the relevant payment gateway and provide the Company with the relevant screenshot.

9.7.  The refund may be conducted, provided that the Company has assessed all the information as well as all the documents provided by the User. It’s being noted that each case will be assessed separately.

10.  Complaints/User violation of applicable terms

10.1.  We work together with Users to keep Bazaraki working properly and the community safe. Please report problems, offensive content, Terms and/or Policy/ies breaches to us using the reporting system (info@bazaraki.com).

10.2.  Without limiting other remedies, we may issue warnings, limit or terminate our Services, remove hosted content and take technical and legal steps to keep Users off Bazaraki if we believe that they are creating problems, infringing the rights of third parties or acting inconsistently with these Terms.

10.3.  However, whether we decide to take any of these steps, remove hosted content or keep a User off Bazaraki or not, we do not have any obligation to monitor the information transmitted or stored on Bazaraki and we do not accept any liability for unauthorized or unlawful content on Bazaraki or use of Bazaraki by Users.

10.3.1.     Prior to any suspension action Bazaraki will issue a warning, provided that it does not violate the purpose of the suspension. In deciding whether to suspend the User’s Account temporarily or permanently, Bazaraki will consider the circumstances of each case, including but not limited to and to the extent that they are known to Bazaraki:

  1. the severity, frequency and timing of complaints or claims; and
  2. the relationship between the complaints and other conduct within Bazaraki.

10.4.  If Bazaraki determines that a User has violated the applicable legal provisions, the rights of third parties (including but not limited to intellectual property rights such as trademarks and copyrights), these Terms, the Bazaraki policies or if Bazaraki has a legitimate interest, such as protecting Users from fraudulent activity, Bazaraki reserves the right to take action against the User, such as:

  1. remove offers, Ads, reviews or content in violation of the law or the terms of use;
  2. send a warning to the user;
  3. delay the publication of ads and other content;
  4. restrict the use of the Services, including buying, selling, and downloading content;
  5. temporarily or permanently suspend the User’s Account.

10.5.  A violation within the meaning of the above-mentioned paragraph occurs, for example, if a User:

  1. provides incorrect information or materials on its own behalf or fails to provide correct information or materials when requested by Bazaraki;
  2. transfers Bazaraki account or gives access to its Bazaraki account to a third party;
  3. significantly harms other Users or Bazaraki or the Company or Company’s officers or associates.

10.6.  When taking action against a User, Bazaraki will consider the legitimate interests of that User, particularly if there are indications that the User is not responsible for the infringement.

10.7.  Bazaraki reserves the right to permanently suspend a User (permanent suspension) if, among other things:

  1. has provided incorrect contact details;
  2. causes significant damage to other users or to Bazaraki, or the Company or Company’s officers or associates;
  3. repeatedly violates these Terms and/or the Bazaraki policies to which they refer and which apply to the User;

10.8.  Once a User is permanently suspended, no claims related to the restoration of the suspended Bazaraki Account.

10.9.  If a User has been suspended or these Terms are terminated by Bazaraki, that User may no longer use the Services, even with other Bazaraki Account, and may not register again.

11.  Content

11.1.  You agree not to copy, distribute or modify content from Bazaraki without our express written consent.

11.2.  You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Bazaraki.

11.3.  Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of Bazaraki (other than your own content).

11.4.  When you give us content, you grant us and represent that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, design, database and intellectual property rights to that content, in any media whether now known or to be discovered in the future.

11.5.  Bazaraki may at times use third party data suppliers to supplement the information you have provided in an Ad. This could include descriptions, product specifications and other content. You may use such information solely in connection with your Bazaraki Ad during the time your Ad is on Bazaraki.

11.6.  The information provided by third parties may be subject to copyright, trademark, and/or other protections. You agree not to remove any such protected information and/or create any derivative works based on the content (other than by including them in your ads). This permission is subject to modification or revocation at any time at Bazaraki sole discretion.

11.7.  You may not have the opportunity to review all of the supplemental data before posting an Ad.

11.8.  Bazaraki assumes no responsibility for the accuracy of any additional data provided by third parties.

11.9.  You remain responsible for the accuracy of the content of your Ads and declare that they fully comply with these Terms and do not include misleading information. If you notice inaccuracies in this data after your Ad is published on Bazaraki, please contact us.

11.10.  The quoted price stated in each Ad is determined by the respective Advertised User, and we are not responsibile for any misleading information.

11.11.  Any videos published on Bazaraki are posted of the participants own free will. All participants are 18 years of age or older and act with their full, free consent and all participants are fully aware of their actions.

11.12.  Adult services: Bazaraki is an advertising and information resource, and as such has no connection or liability with any of the websites or individuals mentioned here. We ONLY sell advertisement space, we are not an escorts agency, nor we are in any way involved in escorting or prostitution business. We take no responsibility for the content or actions of third-party websites or individuals that you may access following links, email or phone contacts from this portal.

12.  Third-party tools

Bazaraki uses third-party tools to enable it to provide its services, improve User experience or to generate statistical information:

12.1. AskWire - Bazaraki

  1. BZRK shall provide market statistics to its users, which are generated by a third party. We are not responsible for the content thereof and/or imply that endorse or approve or confirm the accuracy or correctness of the data and/or information which has been collected via any other party website or database. The market statistics are provided for general information purposes, and we make no representation, warranty or commitment (either expressly or impliedly) and shall have no liability or obligation whatsoever in relation to the content or use of any data and/or information, which results to any transactions completed, and any contract entered into by the User, with any third party relying on such data and/or information and/or use of the market statistics.
  2. These market statistics are based on completed transactions, transfers of ownership and registered purchase agreements, per Cyprus’ Department of Lands & Surveys in order to complement the property listings.
  3. This function shall be provided for Residential Properties (i.e. Apartments, Houses), Land Properties (i.e. Fields, Plots), and any other Type of Property that may be added in the future, based on the repeated evaluation of this function and all available data resources through periods of time.
  4. The User shall select a property listing. The system shall then retrieve certain characteristics of the listing, depending on the property type and shall provide with the market statistics which shall include:
    1. i)     History of Past Transactions in the Area.
    2. ii)     Prices of Sold Properties in the Area, that are similar to the selected (or previewed) property.
    3. iii)     An estimated price range for the property. This estimation is based on the median price per square meter for other similar properties in the area, applied to the size of the property in question.
  5. All Data Provided might change from time to time, based on our re-evaluation of this function. We reserve the right to change All Data Analytics provided at any time based on several factors, including but not limited to User Feedback, Periodic Market Data or other available resources obtainable during each re-evaluation period.

12.2. Recombee

  1. We have incorporated Recombee features on the Website, to improve each User’s experience, by providing personalised Ad suggestions.
  2. For this purpose, we may collect and use information in relation to your activity and preferences on the Website for the suggestion of personalised Ads. Information collected for the suggestion of personalised Ads will only be used for this purpose. By using our platform, you agree to the collection and use of Personal Data for the suggestion of personalised Ads.
  3. Although our intention is to suggest personalised Ads, we do not guarantee the accuracy or the reliability of the suggestions by Recombee. We encourage you to consider each Ad suggested carefully. We do not accept any liability for any detriment caused due to reliance on suggested Ads.
  4. Recombee features on the Website might be updated or extended in the future to include additional features. We reserve the right to update or amend the services of personalised suggestions without prior notification. Any important changes on the Data and Privacy Policy will be announced to Users.

12.3. Freshworks

  1. We have partnered with Freshworks Inc. to integrate a live chat feature on the Website (the “Live Chat”), aimed at enhancing User experience by providing an efficient and seamless way for Users to communicate with the Bazaraki Customer Success Team.
  2. Through the Live Chat, Users may connect with our officers in real-time to request support, to resolve issues or receive answers to questions in relation to Bazaraki or its services.
  3. The Live Chat may track a User’s activity on the Website to enhance the quality of service and provide personalised assistance. Further, the Live Chat may collect User’s Personal Data automatically or based on information voluntarily provided by a User. We are committed to protecting Users’ privacy and to handling all Personal Data collected in accordance with applicable data protection laws and regulations. For more details on how Users’ Personal Data is processed, please refer to our Data and Privacy Policy.

12.4. Bazaraki Tools

We develop technologies solely for the purpose of facilitating and providing the best possible experience to Bazaraki’s Users, and not to replace any licensed profession. Accordingly, you acknowledge and agree that:

12.4.1. Property valuation

a) Based exclusively on data derived from listings available on Bazaraki, on proprietary internal machine learning models developed by us, and without the use of any external tools, platforms and/or data, we provide automated, non-binding estimations regarding the value of real estate properties.

b) All processing is carried out entirely on proprietary servers, without any transfer or disclosure of data to third parties.

c) Such estimations are provided solely for informational purposes, may contain inaccuracies or deviations, and do not constitute professional, real estate brokerage or valuation advice, nor do they replace certified property valuers or any other licensed professionals in the relevant field.

13.  Personal Data

13.1.  By using Bazaraki, you agree to the collection, transfer, storage and use of your personal information by Bazaraki, on Bazaraki and/or Google LLC servers located in various countries. You also agree to receive marketing communications from us in relation to the Services.

13.2.  We undertake to use any information that will be made available to us to provide the Services with due confidentiality unless disclosure of any such information becomes legally necessary. In such a case, we will take all appropriate security measures as deemed necessary. You hereby acknowledge and agree that the information and other personal data as required will be used within and for the purposes of the provision of the Services.

13.3.  Personal data may be used, stored, processed, and transmitted only for the purpose of providing the Services. You hereby declare that you consent to the provision of your personal data for the purposes stated herein.

13.4.  Please also read Data and Privacy Policy.

14.  Liability

14.1.  You agree that you will not make us responsible for actions taken by any User or for the content of Ad of any Advertised User.

14.2.     It is not our responsibility to review User posts, and we are not involved in the actual transactions between Users. As most of the content on Bazaraki comes from Advertised Users, we do not guarantee the accuracy of postings or User communications or the quality, safety, or legality of what is advertised.

14.3.  In no event do we accept liability of any description for the posting of any nature of the posting, any unlawful, threatening, abusive, defamatory, obscene, discriminatory or indecent information, or material of any kind which violates or infringes the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law.

14.4.  You acknowledge that we cannot guarantee continuous, error-free, or secure access to our services or that defects in the service will be corrected. While we use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the operation and availability of our sites, services, applications or tools.

14.5.  Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations, and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not responsible for any loss, whether in money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use Bazaraki, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.

14.6.  Purchases and transactions are the sole responsibility of the Users and are binding only on those Users. We do not become a party and does not participate in any way in any purchase agreement or other agreement concluded between the Users directly or indirectly using the Website and / or the Services provided through Bazaraki. We are in no way bound by such contracts or agreements concluded between Users and do not acquire any rights or undertake obligations that might be arisen by them.

14.7.  As a result of the above, we assume no responsibility and disclaim any claims (whether civil, criminal, indirect or ancillary) due to any dispute, act or omission in connection with the negotiation, conclusion, validity or performance of such agreement or contract and generally due to any dispute arising between the Users.

14.8.  Indicatively and not restrictively, we bear absolutely no responsibility and disclaim any claim in the following:

  1. 14.8.1.     Negotiation and Execution of the Terms of the Contract
    1. It becomes clear that the Users are free to negotiate and agree on the specific terms of the transaction between them. Users can contract in the way and type that they alone will choose their own responsibility. We do not take part and does not bear any responsibility regarding the negotiation, but also regarding the execution of the above terms.
    2. Further, you acknowledge that we are not responsible for any damages caused to persons and Objects, or for other direct, indirect or ancillary damages suffered by the User or third party due to or on the occasion of the conclusion or execution of a purchase contract.

It is therefore the sole responsibility of both Advertised User and Interested User, to agree to the terms of their agreement as well as to fulfil their obligations under such agreement while, it becomes clear that the Advertised User can claim exclusively from the Interested User (and in no case from Bazaraki) the agreed price.
  3. 14.8.3.     Differences in the quality and characteristics of the Objects
    1. We bear no responsibility for the security or authenticity of the Objects, for any inherent actual or legal defects, lack of agreed properties, as well as in case the quality and general characteristics of the Objects do not meet the description given, in the posted Ad. In the event of any dispute between Users regarding the above, you expressly acknowledge that we assume no liability, therefore there is no obligation on our side to provide civil restitution, compensation, or payment to Users.
  4. 14.8.4.     Compliance with the Legislation
    1. It is the sole responsibility of the Users to comply with the applicable legislation and the principles imposed by good faith and business ethics and to ensure that the content of the agreement or contract between them and any act or action does not contradict the above.
    2. In no event shall the Company and/or its employees, directors, associates, officers etc. be liable to you or any such third party for any direct, indirect, punitive, exemplary, incidental, special or consequential damages or any damages whatsoever, including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of Bazaraki the delay or inability to use the Website, the provision of or failure to provide Services, or for any information, software, products, services and related graphics obtained through Bazaraki, or otherwise arising out of the use of the Bazaraki, whether based on contract, tort, strict liability or otherwise, even if the Company or any of its employees, directors, associates etc. have been advised of the possibility of damages.

We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

15.2.  This Agreement is governed and construed in all respects by the laws of the Republic of Cyprus.

15.3.  It is hereby agreed that any dispute that might be arisen pursuant to these Terms, shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.

16.  General

16.1.  If any provision of these Terms is held to be invalid, void or for any other reason unenforceable, such provision shall be struck out and shall not affect the validity and enforceability of the remaining provisions.

16.2.  We reserve the right, in our sole discretion, to modify, convert or update in any other way the Terms. These amendments take effect immediately upon posting. If the User does not agree to the change of the Terms, he must stop using the Bazaraki and our Services. By using Bazaraki after posting notice of such modifications, conversions, or updates, you agree to be bound by the revised terms.

16.3.  We reserve the right to modify or terminate in part or in whole, temporarily or permanently, Bazaraki and Services with or without prior notice to the User and the User accepts that he or any third party does not maintain to Bazaraki any claim for any modification or interruption of the Website and the Services.

16.4.  A person who is not a party of this User Agreement has no right to enforce any term.
